Memorandum of Agreement

Memorandum of Agreement

Between

Frontier School Division 

(the "Division")

-and-

Frontier Teachers' Association

of the Manitoba Teachers' Society

(the "Association")

WHEREAS:

  1. For the 2022-2023 school year, despite the extensive recruitment efforts by the Division, the Division is facing significant teacher staffing shortages, with in excess of forty (40) vacant teaching positions as of the date of this Memorandum of Agreement;

 

  1. In order to address the temporary staffing shortage, the Division wishes to offer an added incentive payment in an effort to attract new teachers to the Division;

 

  1. The Association recognizes the importance of maintaining a full staffing complement and maintaining class sizes to the greatest extent possible and is prepared to agree to a temporary incentive on the terms and conditions set out herein.

NOW THEREFORE, in consideration of the mutual covenants and agreements herein contained, and for other good and valuable consideration, the receipt and sufficiency of which is hereby acknowledged by each of the parties hereto, the parties hereby agree as follows:

 

  1. This Memorandum of Agreement is made separate and apart from the Collective Agreement between the Association and Division and is independent of, and unrelated to, any payments under the Collective Agreement. Notwithstanding the foregoing, the Parties agree that any dispute regarding the interpretation or  administration of  this  Memorandum of Agreement shall be addressed through the grievance and arbitration procedure, as set out in the Collective Agreement.

 

  1. The Parties agree that the Division shall offer to all New Applicants, as hereinafter defined. an incentive payment equal to $5,000.00, subject to statutory deductions and remittances, which payment is subject to the New Applicant entering into the Incentive Payment Agreement, attached hereto at Schedule "A”.

 

  1. For the purposes of this Memorandum of Agreement, a New Applicant shall be  considered any teacher who, after the date this Memorandum of Agreement is executed, is eligible to be certified In Manitoba, who enters into a Teacher-General or Limited Term teaching contract with the Division for at least the entire 2022-2023 school year, and who has not worked for, or been employed with, the Division, in the twelve (12) months preceding September 1, 2022. For greater certainty, teachers currently on leave, for any reason whatsoever, shall be considered employed with the Division and not eligible for an incentive payment hereunder.    In addition, this Memorandum of Agreement does not apply to substitute teachers and/or teachers who are recent graduates of the Division's P.E.N.T. Program.

 

  1. The Parties acknowledge and agree that the incentive payment, as set out above, is necessary to address a temporary need for the 2022-2023 school year only. The Parties further acknowledge and agree that the incentive payments contemplated hereunder, and this Memorandum of Agreement, will expire on June 30, 2023.
